Effective date: 1 November 2026. Please read these terms carefully before submitting a property to the Verified Homestays directory on searchdarjeeling.com (the “Website”). The Website is operated by Search Darjeeling (“we”, “us”). By submitting a listing you (“Owner”) agree to these terms.
1. Our role
Search Darjeeling is an independent information website. We are not the Darjeeling Police, any government body, a travel agent, a hotel aggregator, an online travel platform or a booking service. We do not take bookings or payments, do not set prices and are not a party to any arrangement between an Owner and a guest. We act only as a publisher of directory information, including information supplied by third parties.
2. Who may list
You may submit a property only if you are its owner, or you are legally authorised by the owner to list it. You confirm that the property exists, is lawfully operated, and that you hold, or will hold before accepting guests, every registration, licence, permission and certificate required by applicable law (including, where applicable, police or local authority registration, trade or hospitality licences, tax registration, fire and safety requirements and guest-registration obligations). Submitting a listing does not mean we have checked any of these.
3. Accuracy of information
You must give true, accurate, current and complete information and keep us informed of changes. You must not submit false, misleading, copied or impersonating details, or details of a property you are not authorised to list. You are solely responsible for everything you submit.
4. Consent to publish; your data
By submitting, you consent to us publishing the property name, type, area, address, public contact number, optional website or social link and optional description on the Website and in related search, sharing and promotional features. The owner name and email address are kept private and used only to review your submission, contact you about it and notify you of the decision. We may retain submission records for administration, dispute handling and legal compliance. You may ask us to correct or remove your listing or personal data at any time by emailing darjinfo@gmail.com. Your use of the Website is also subject to our Privacy Policy. You confirm that any contact number you provide is yours or that you have the holder’s permission to publish it.
5. Review and labels
Every submission is reviewed only for basic format and apparent validity. We may approve, reject, edit, suspend or remove any listing at any time, with or without reason or notice, and we do not guarantee that any listing will be published, remain published or receive any particular position, visibility, enquiries or bookings. Listings taken from the Darjeeling Police public list are labelled “Police-certified” solely because they appear on that list as of the date we last synced it. Listings submitted through the form are labelled “Owner-listed” and have not been verified by us against any government record unless we expressly state otherwise. Neither label is an endorsement, certification, rating or guarantee by us.
6. Content licence
You grant us a free, non-exclusive, worldwide, royalty-free licence to display, store, reproduce, format and share the content you submit for operating and promoting the Website. You confirm you have the right to grant this licence and that your content does not infringe anyone’s rights.
7. Prohibited conduct
You must not submit spam, advertising links, offensive, unlawful, discriminatory or deceptive content; use automated tools or bots to submit listings; submit multiple or duplicate listings for the same property; interfere with the Website’s security; or use the form to collect other people’s data. We may block any person or network that does so.
8. Dealings with guests
All enquiries, bookings, payments, cancellations, refunds, disputes, guest safety, guest identification and legal compliance are strictly between you and the guest. You are solely responsible for the safety, legality, quality and description of your property and services, and for honouring the prices and terms you quote. We are not responsible for any act, omission, claim or dispute between you and any guest or third party.
9. Fees
Listing is currently free. We may introduce paid or featured options in future; no fee will be charged without your clear agreement.
10. Disclaimer
The Website and all listings are provided “as is” and “as available” without warranties of any kind, express or implied, including accuracy, completeness, availability, fitness for a purpose or non-infringement. We do not warrant that the Website will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent permitted by law, Search Darjeeling and its owners, editors, contributors and service providers are not liable for any direct, indirect, incidental, special or consequential loss, loss of income or reputation, injury, damage, claim or dispute arising from your listing, from any content on the Website, from any guest or visitor, or from your use of or inability to use the Website. Nothing in these terms excludes liability that cannot lawfully be excluded.
12. Indemnity
You agree to indemnify and hold harmless Search Darjeeling, its owners, editors and contributors against all claims, losses, damages, penalties, costs and expenses (including reasonable legal fees) arising from your listing, your breach of these terms or of any law, inaccurate or unauthorised content, or any dispute between you and a guest or third party.
13. Removal and complaints
To report an error, request a correction or removal, or raise a complaint about any listing, email darjinfo@gmail.com with the listing name and details. We will review requests within a reasonable time and may correct, suspend or remove the listing while we do so.
14. Changes to these terms
We may update these terms from time to time by posting the revised version on this page. Continued use of the Website or an existing listing after an update means you accept the revised terms.
15. General
If any part of these terms is found unenforceable, the rest remains in effect. These terms are governed by the laws of India, and the courts at Darjeeling, West Bengal shall have exclusive jurisdiction, subject to any mandatory rights you may have under law.
